Welcome to Loan Link, operated by Loan Link Holdings LLC ("Company," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our website, mobile applications, and lending services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.

1. Acceptance of Terms

By creating an account, submitting a loan application, or otherwise using our Services, you represent and warrant that:

  • You have read, understood, and agree to be bound by these Terms
  • You are at least 18 years of age (or the age of majority in your state of residence)
  • You have the legal capacity to enter into a binding agreement
  • You are a resident of the United States
  • All information you provide is accurate, current, and complete
  • You will maintain the accuracy of such information

We reserve the right to refuse service, terminate accounts, or cancel loan applications at our sole discretion if we believe you have violated these Terms or provided false information.

2. Eligibility Requirements

To be eligible for a loan through Loan Link, you must meet ALL of the following requirements:

  • Age: You must be at least 18 years old (19 in Alabama and Nebraska, 21 in Mississippi)
  • Residency: You must be a legal U.S. resident with a valid Social Security Number
  • Bank Account: You must have an active checking account in your name at a U.S. financial institution
  • Income: You must have a verifiable, regular source of income (employment, self-employment, benefits, or other documented income)
  • Contact Information: You must provide a valid email address and phone number
  • Identity Verification: You must be able to verify your identity through our verification process

Meeting these requirements does not guarantee loan approval. All loan applications are subject to our underwriting criteria and credit evaluation (where applicable).

3. Loan Products and Services

Loan Link offers the following loan products, subject to availability in your state:

Cash Advance Loans: Short-term loans ranging from $200 to $1,000, designed for immediate financial needs. These loans are typically due on your next payday. Cash advances carry a flat fee that is disclosed at the time of application.

Personal Loans: Installment loans ranging from $200 to $5,000 with repayment terms typically between 12 and 60 months. Personal loans have fixed monthly payments and APRs ranging from 5.99% to 35.99% based on your creditworthiness.

Payday Loans: Short-term loans ranging from $200 to $1,500, due on your next payday. Payday loans carry fees that are disclosed at the time of application. These loans are designed for short-term needs and should not be used as a long-term financial solution.

Not all loan products are available in all states due to state-specific lending regulations. During the application process, we will inform you which products are available in your state.

4. Interest Rates, Fees, and APR Disclosure

We believe in transparent pricing. All rates and fees are disclosed BEFORE you accept any loan offer. You are under no obligation to accept a loan offer.

Personal Loan APRs: Annual Percentage Rates for personal loans range from 5.99% to 35.99%. Your actual APR depends on your credit history, loan amount, loan term, and other factors. For example, a $3,000 personal loan with a 24-month term and 18.99% APR would have monthly payments of approximately $150.47 and total interest of $611.28.

Cash Advance and Payday Loan Fees: These products carry flat fees rather than traditional interest rates. Fees are calculated based on the loan amount and are fully disclosed before you accept the loan. When expressed as an APR, these fees may result in high APRs due to the short-term nature of the loans. For example, a $500 cash advance with a $75 fee due in 14 days has an APR of approximately 391%.

No Hidden Fees: We do not charge application fees, origination fees, or prepayment penalties. The only fees you will pay are the interest/fees disclosed in your loan agreement and any late payment fees if applicable.

Late Payment Fees: If you miss a payment or pay late, you may be charged a late fee as disclosed in your loan agreement. Late fees vary by state and loan type. Continued failure to pay may result in additional collection activities and reporting to credit bureaus.

5. Loan Application and Approval Process

When you apply for a loan:

  • Application: You will be asked to provide personal information, employment/income information, and banking information
  • Verification: We may verify the information you provide through various means, including but not limited to bank account verification, identity verification services, and credit checks (for personal loans)
  • Credit Inquiry: For personal loans, we may perform a soft credit inquiry to show you rates you qualify for. This does not affect your credit score. A hard credit inquiry will only occur if you accept a loan offer
  • Decision: We will provide you with a loan decision. If approved, you will receive a loan offer detailing the amount, term, APR/fees, and payment schedule
  • Acceptance: If you accept the loan offer, you will sign an electronic loan agreement
  • Funding: Upon acceptance, funds will be deposited to your bank account, typically within one business day

We reserve the right to decline any loan application for any reason. Approval is not guaranteed and is subject to our underwriting criteria.

6. Repayment Terms

Personal Loans: Personal loans are repaid in equal monthly installments over the loan term. Payments are due on the same day each month. You may set up automatic payments from your bank account or make manual payments.

Cash Advances and Payday Loans: These loans are due in full on your next payday or within the term specified in your loan agreement. The full amount (principal plus fees) will be debited from your bank account on the due date unless you make other arrangements.

Early Repayment: You may pay off any loan early without penalty. For personal loans, early repayment will reduce the total interest you pay.

Late or Missed Payments: If you cannot make a payment on time, contact us immediately. Late payments may result in:

  • Late fees as disclosed in your loan agreement
  • Negative impact on your credit score
  • Collection activities including calls, emails, and letters
  • Potential legal action to collect the debt
  • Reporting to credit bureaus

7. Electronic Communications and E-Sign Consent

By using our Services, you consent to receive electronic communications from us, including:

  • Loan documents and disclosures
  • Payment reminders and confirmations
  • Account updates and notices
  • Marketing communications (which you may opt out of)

You agree that electronic signatures, contracts, and records have the same legal effect as physical signatures and paper documents. You have the right to receive paper copies of documents upon request.

8. Account Security

You are responsible for maintaining the security of your account credentials. You agree to:

  • Keep your password confidential and not share it with anyone
  • Notify us immediately of any unauthorized access to your account
  • Use secure networks when accessing your account
  • Log out of your account after each session

We are not liable for any losses resulting from unauthorized access to your account due to your failure to safeguard your credentials.

9. Prohibited Uses

You agree NOT to:

  • Provide false, inaccurate, or misleading information
  • Use the Services for any illegal purpose
  • Attempt to obtain multiple loans using false identities
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to any part of the Services
  • Use any automated means to access the Services
  • Reverse engineer or decompile any part of the Services

Violation of these prohibitions may result in immediate termination of your account and legal action.

10. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, and software, are the property of Loan Link Holdings LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Services without our express written permission.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOAN LINK HOLDINGS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT OF FEES YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Loan Link Holdings LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any rights of another.

14. Dispute Resolution and Arbitration

Arbitration Agreement: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules.

Class Action Waiver: YOU AGREE THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@loanlinkholdings.com within 30 days of first using the Services.

Small Claims Exception: Either party may bring an individual action in small claims court if the claim qualifies.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Delaware.

16. Changes to Terms

We may modify these Terms at any time by posting the revised Terms on our website. Your continued use of the Services after any changes constitutes your acceptance of the new Terms. We will notify you of material changes by email or through the Services.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any loan agreements you enter into, constitute the entire agreement between you and Loan Link Holdings LLC regarding your use of the Services and supersede any prior agreements.

APR and Rate Information

Personal Loans: APRs range from 5.99% to 35.99%. Your actual APR will depend on factors including your credit history, loan amount, and loan term. Representative example: A $2,500 loan with a 36-month term at 18.99% APR would have monthly payments of $91.66 and a total repayment amount of $3,299.76.

Cash Advances: Cash advances ($200-$1,000) have fees ranging from $10 to $30 per $100 borrowed, depending on the loan amount and your state of residence. When expressed as an APR, these fees may be high due to the short-term nature of these loans.

Payday Loans: Payday loans ($200-$1,500) typically carry fees of $15 per $100 borrowed. A $500 payday loan with a $75 fee due in 14 days has an APR of approximately 391%. Payday loans are expensive and should only be used for short-term financial needs.
