Online Services Agreement

1. Agreement Overview

This Agreement is a legal contract between you ("you" or "your") and Loan Link Holdings LLC ("Loan Link," "we," "us," or "our"). By accessing or using the Online Services, you agree to be bound by this Agreement, our Terms of Use, and our Privacy Policy. If you do not agree, do not access or use the Online Services.

2. Definitions

• "Account" means your registered user profile and credentials.
• "Application" means a loan application submitted through the Online Services.
• "Content" means all text, data, graphics, and materials within the Online Services.
• "Services" means the Online Services and related loan-related functionality.

3. Eligibility and Access

You represent that you are at least 18 years old (or older where required by state law) and:

• Are a U.S. resident with a valid Social Security Number.
• Have legal capacity to enter into a binding agreement.
• Can provide accurate and complete information.

We may deny or terminate access at any time in our sole discretion.

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use.

5. Electronic Communications and E‑Sign Consent

You consent to receive communications electronically, including notices, disclosures, and agreements. You agree that electronic signatures are legally binding and have the same effect as handwritten signatures. You may request paper copies by contacting us, and you may withdraw your consent where permitted by law.

6. Communications Authorization

By providing your contact information, you authorize us and our service providers to contact you by telephone, SMS/text message, email, and other means regarding your account, applications, and related services, including at numbers provided by you (even if those numbers are on a do-not-call list).

7. Use of Online Services

You agree not to:

• Use the Online Services for any unlawful purpose.
• Provide false, misleading, or incomplete information.
• Attempt to access, interfere with, or disrupt our systems or security controls.
• Use automated scripts or scraping tools without permission.

8. Loan Application Process

The Online Services allow you to submit Applications and manage your information. Submission of an Application does not guarantee approval. We may verify your information through third‑party services and may require additional documentation.

9. Authorizations for Verification

You authorize us to verify your identity, employment, income, and banking information, and to obtain credit reports where applicable. You understand that we may use third‑party data providers to perform these verifications.

10. Payment Authorizations

If you accept a loan offer, you may authorize electronic payments (including ACH debits) from your bank account. You agree that we may initiate debit entries according to your loan agreement and applicable law. You may revoke authorization only as permitted by your loan agreement and law.

11. Fees and Disclosures

Rates, fees, and repayment schedules are provided to you before accepting any offer. We do not charge application fees. Any fees or interest are disclosed in your loan agreement and applicable disclosures.

12. Availability and Service Changes

The Online Services may be modified, suspended, or discontinued at any time. We do not guarantee uninterrupted access and may perform maintenance without notice.

13. Third‑Party Services

The Online Services may rely on third‑party providers (e.g., identity verification, analytics, messaging). We are not responsible for the acts or omissions of these third parties and their terms may apply.

14. Privacy and Data Security

Our collection and use of information are governed by our Privacy Policy. We use reasonable security measures to protect your information but cannot guarantee absolute security.

15. Disclaimer of Warranties

THE ONLINE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THE ONLINE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

17. Indemnification

You agree to indemnify and hold harmless Loan Link Holdings LLC and its affiliates from any claims or losses arising out of your use of the Online Services or violation of this Agreement.

18. Dispute Resolution and Arbitration

Any dispute arising from the Online Services shall be resolved by binding arbitration on an individual basis. Class actions are waived. You may opt out of arbitration by providing written notice within 30 days of first using the Online Services.

19. Governing Law

This Agreement is governed by the laws of the State of Delaware, without regard to its conflict‑of‑law principles.

20. Changes to This Agreement

We may update this Agreement at any time by posting the revised version online. Your continued use of the Online Services after changes become effective constitutes acceptance of the revised Agreement.
